NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. NON-PURCHASE ENTRIES AND PURCHASE ENTRIES HAVE AN EQUAL CHANCE OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
1. ELIGIBILITY: To enter the Gorton's All Natural Summer Sweepstakes (the "Sweepstakes"), each entrant must be a legal resident of the United States and must also be 18 years of age or older as of the date of entry. Employees of the Sponsor (as later defined), the Sponsor Affiliates (as later defined) or any of the members of their immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) or same household of each are not eligible to participate. This Sweepstakes is void where prohibited or restricted by law, and is subject to all applicable federal, state and local laws.
2. TO ENTER: Simply fill in the required fields on www.gortons.com/allnaturalsweeps.php , from May 19, 2008 through November 1, 2008. One entry per participating individual. Neither Gorton's Inc., to include its parent company, subsidiaries, affiliates, and each of their directors, officers, employees or agencies, nor any of their respective partners ("Sponsor") nor Blue Chip Marketing & Communications, their respective parent companies, subsidiaries, affiliates, and the directors, officers, employees or agencies, nor any of their respective partners, (collectively, the "Sponsor Affiliates") are responsible for electronic network, scanner or computer hardware or software malfunction and/or transmission failure, loss or delayed or corrupted data transmissions, or any technical or human failures, errors or difficulties of any kind.
3. ALTERNATE ENTRY METHOD (MAIL-IN): If you do not wish to enter online, you may also enter the Sweepstakes by hand printing your name, store name, complete address, including zip code and day time telephone number on a plain 3" x 5" card. Mail your entry in a stamped envelope to: Gorton's All Natural Summer Sweepstakes, P.O. Box 622, Northbrook, IL 60065-0903. Mail-in entries are limited to 1 entry per envelope. Each entry must be hand-printed, postmarked by November 1, 2008 and received by November 7, 2008. Neither the Sponsor nor the Sponsor Affiliates are responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated entries or postage due mail. Photocopies, mechanically reproduced, forged or altered mailed entries and facsimiles are void. Incomplete or illegible entries are not eligible. Mail-in envelopes larger then a #10 envelope will be automatically disqualified. All entries become the property of the Sponsor and will not be returned.
4. GRAND PRIZE AND APPROXIMATE RETAIL VALUE (ARV): One (1) grand prize ("Grand Prize") will be awarded. The winner of the Grand Prize will be awarded one (1) Outdoor Grill (ARV: $599.00). Each Grand Prize is subject to applicable terms and conditions. The Sponsor reserves the right to substitute a Grand Prize with prize of comparable or greater value if the Grand Prize cannot be awarded as described for any reason.
5. FIRST PRIZES AND APPROXIMATE RETAIL VALUES (ARV): A total of five (5) first prizes (each a "Prize" and, collectively, the "First Prizes") will be awarded. Each winner of a First Prize will be awarded (1) $100.00 in Grilling Cash (ARV First Prize: $100.00). Each First Prize is subject to applicable terms and conditions. The Sponsor reserves the right to substitute a First Prize with prize of comparable or greater value if a First Prize cannot be awarded as described for any reason. (Total Retail Value of All Prizes: $1,099.00).
6. WINNERS: Winners will be selected in a random drawing, on or about November 14, 2008, from among all eligible entries received. Drawing will be conducted by Blue Chip Marketing & Communications, an independent judging organization, whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning are dependent upon the number of eligible automatic and mail-in entries received. Winners must comply with all Sweepstakes rules as published. Potential Grand Prize winner will be notified by phone and/or UPS and will be required to complete, sign and return, a notarized Affidavit of Eligibility/Release of Liability and, where legal, Publicity Release (together the "Documents"). Potential Grand Prize winner is required to return Documents within 7 days from the postmark date on the notification letter. Failure to comply with these requirements or return of notification of Grand Prize as undeliverable will result in forfeiture of prize and an alternate winner will be selected. Potential First Prize winners will be notified by phone and/or mail and will be required to complete and return an address verification letter. Potential First Prize winners are required to return Documents within 14 days from the postmark date on the address verification letter. Failure to comply with these requirements or return of notification or First Prize as undeliverable will result in forfeiture of prize and an alternate winner will be selected. Limit one prize per person/family/household. By entering this Sweepstakes, entrants agree to submit to the jurisdiction and venue of the federal, state and local courts located in Essex County in the Commonwealth of Massachusetts.
7. CONDITIONS OF PARTICIPATION: THE FOLLOWING TERMS & CONDITIONS APPLY: Neither the Sponsor nor the Sponsor Affiliates assume any responsibility for incorrect or inaccurate capture of entry information, including, but not limited to, technical malfunctions, human or technical error, seeding or printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect or failures of: any telephone or computer line or network, computer equipment, software or any combination thereof. In the event this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsor reserves the right to cancel, terminate, or suspend the automatic portion of the Sweepstakes and in such event, to select winners for any remaining prizes by random drawing from among all valid automatic entries received, up to such time of cancellation, termination or suspension and all eligible mailed entries received. Entrants agree to be bound by these Official Rules and the decisions of the judges. All aspects of the prizes are NON-TRANSFERABLE and no substitutions are allowed except at the Sponsor's sole discretion. No cash equivalent or exchange of prize is permitted (except at the Sponsor's sole discretion). Grand Prize award is valid for one (1) year from the award date and must be redeemed within this redemption period or prize will be forfeited. Each Winner is solely responsible for any local, state or federal taxes resulting from winning and accepting a prize.
8. ENTRANTS, BY THEIR PARTICIPATION, AND WINNERS, IN ACCEPTING THEIR PRIZES, AGREE TO INDEMNIFY AND HOLD HARMLESS AND WAIVE ANY AND ALL CLAIMS OF LIABILITY OF ANY KIND WHATSOEVER AGAINST THE SPONSOR AND/OR THE SPONSOR AFFILIATES INCLUDING, BUT NOT LIMITED TO, ANY ACCIDENT, LOSS, INJURY OR DEATH OCCURRING OR IN ANY WAY RELATED TO THE PRIZES OR USE/MISUSE THEREOF OR WHILE TRAVELING TO AND/OR FROM A LOCATION TO OBTAIN OR USE THE PRIZES OR PARTICIPATION IN THIS SWEEPSTAKES.
NEITHER THE SPONSOR NOR THE SPONSOR AFFILIATES MAKE ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. FURTHER, THE SPONSOR AND SPONSOR AFFILIATES SHALL ACCEPT NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSES, OMISSIONS, OR ACTS OF ANY GOVERNMENT OR AUTHORITY.
9. Winners, in accepting their prizes, consent to the use of their names, addresses (city, state), photographs and likenesses for purposes of advertising, trade and promoting in any and all media on behalf of the Sponsor, without further compensation except where prohibited by law.
10. To receive a Winners' List, mail a self-addressed, stamped envelope, by November 14, 2008 to: Gorton's All Natural Sweepstakes Winners, P.O. Box 622, Northbrook, IL 60065-0622.
